The New York Supreme Court has ruled that the Match for the 33rd America’s Cup must take place in February 2010, in accordance with the decision handed down by Justice Herman Cahn, in the same Court.
In the second decision, on the point of BMW Oracle Racing having to provide a Customs House Registry document of their 90ft multihull, currently sea trialling, the Court did not uphold the complaint raised by Alinghi/Societe Nautique de Geneve. There is no requirement BMW Oracle to provide the CHR dopcument now, or within 30 days as requested by the Alinghi parties.
Both rulings were made from the Bench by Justice Shirley Werner Kornreich. She further ruled that Alinghi/Societe Nautique de Geneve had to announce the venue by 8 August 2009 or face further Court attention.

Bitter America’s Cup rivals Alinghi of Switzerland and BMW Oracle Racing of San Francisco are closer to getting out of the courts and onto the water for a rare one-on-one showdown in fast monster boats.
Justice Shirley Werner Kornreich of the Supreme Court of the State of New York on Thursday upheld an order that the defending champion Swiss meet the Americans in the best-of-three match in February.

The curious craft with its 10-foot wingspread looks like a sleek jet plane, not what it really is: a small submarine capable of flying deep beneath the ocean’s surface to survey whatever’s there.
And that’s just what it will do next month when scientists and conservationists from California’s national marine sanctuaries take it underwater in Monterey Bay and start tracking everything that’s living there, from whales to tiny krill.
The newly designed, battery-powered submarine is only 20 feet long and is built to carry two people to depths of 1,500 feet as they cruise at a sedate 7 mph.
